The Innovative Design Protection and Piracy Prohibition Act (IDPPPA) was the focus of a recent presentation by G&B associate John R. Yates to the Intellectual Property Section of the Ventura County Bar Association. The IDPPPA or Design Piracy Act, as it is sometimes called, was unanimously passed by the Senate Judiciary Committee in December 2010 and is currently pending before the full Senate. Likely to be enacted, the bill provides limited copyright protection to fashion designs, and creates a “substantially identical” standard for infringement, largely borrowed from trademark law.
